Your privacy is important to A Twist of Whimsy.  Please read this privacy notice carefully as it contains important information on who we are, how and why we collect, store, use, and share personal information, your rights in relation to your personal information and on how to contact us in the event you have a complaint. This Privacy Policy does not apply to the practices of third parties that we do not own or control.

1. Who We Are

A Twist of Whimsy is an online jewelry business operating out of the United States. We collect, use and are responsible for certain personal information about you.

2. The Personal Information We Collect and Use

A Twist of Whimsy may collect, use, and is responsible for certain personal information that you provide when you order a product, voluntarily sign up for e-mails, participate in special offers and promotions, or contact A Twist of Whimsy via e-mail. The information collected may include your name, e-mail, address, phone number, and/or billing information. You are not required to provide any personally identifiable information to merely access or visit this website.

A Twist of Whimsy or its third-party vendors may collect non-personal information through the use of technologies such as Google Analytics for generating reports used in marketing our products. Non-personal information might include the browser you use, your landing page on our website, areas you visit, search terms, links you may select to other sites, as well as technical information about your means of connection to this website such as the operating systems and the Internet service providers utilized and other similar information. 

If you are located in the European Economic Area (EEA), we are regulated under the General Data Protection Regulation which applies across the European Union (including in the United Kingdom) and we are responsible as controller of that personal information for the purposes of those laws.

3. How We Use Your Personal Information

A Twist of Whimsy collects such information in order to fulfill orders, send e-mails related to your order, run promotions and contests, send e-mail newsletters (if you sign up), settle disputes, and to provide other necessary customer support. Your information is used to provide the services you requested and in our legitimate interest to improve services.

4. Who We Share Your Personal Information With

A Twist of Whimsy respects your privacy and will never sell, trade or transfer your personally identifiable information to third parties (beyond what is necessary for fulfilling a customer transaction or for the basic functionality of an online service) without your consent.

We do, however, share your name and delivery address details with our third-party suppliers, credit card processors or shipping companies including Shopify, PayPal, Stripe and the United States Postal Service. If you sign up for special offers by providing your email address, your email is collected by the third-party supplier Mail Chimp. 

A Twist of Whimsy may also share your information, if necessary, to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases, if required by tax law.

To be in compliance with laws, we may collect, use, retain, and share your information if we believe in good faith that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of customers, or others.

5. Your Payment Details

When you place an order with us, you will pay through Stripe or PayPal. The only payment details we maintain are the amount you paid and the payment processor. No other details (account numbers) are available to us.

6. How Long Your Personal Information Will Be Kept

Your personal information will be retained only for as long as necessary to provide you with our shop services and as described in our Privacy Policy. However, we may also be required to retain this information to comply with legal and regulatory obligations, to resolve disputes, and to enforce agreements. Your data will generally be kept for a period of six years.

7. Use and Transfer of Your Information Out of the EEA

This website is operated in the United States and third parties with whom we might share your personal information as explained above are also located in the United States.  If you are located in the EEA or elsewhere outside of the United States, please be aware that any information you provide will be transferred to the United States. By using this website, participating in any of its services and/or providing your information, you consent to this transfer. Any transfer of your personal information will be subject to the General Data Protection Regulations that are designed to help safeguard your privacy rights and give you remedies in the unlikely event of a misuse of your personal information.

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. Your rights are described as follows:

  • You have the right to access and receive a copy of the personal information we retain about you by contacting us using the contact information below. 
  • You may also have rights to change, restrict our use of, or delete your personal information. Absent exceptional circumstances (like where it is required to store data for legal reasons), we will delete your personal information upon request. 
  • You can object to (i) our processing of some of your information based on our legitimate interests and (ii) receiving marketing messages from us after providing your express consent to receive them. In such cases, your personal information will be deleted unless we have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons. 
  • If you reside in the EU and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
